LICENSING LAW AND THE BAR
Licences are granted either annually or for a period not exceed ing seven years. A person who is licensed to sell liquor at certain premises may obtain from the justices an Occasional Licence to sell, for not more than three days, at some other place, e.g., at a local cattle show, cricket match, ball or other gathering. Milk and Music In many localities a licence from the local council or justices is required for the playing of music in public. This could include music by orchestra or wireless in a hotel or bar. Some local authorities do not insist on a Music Licence if the music isonly a subsidiary or incidental part of the service provided. In any case the necessary copyright fees for the playing of music, whether by orchestra or by the B.B.C. broadcasts, should be obtained from the Performing Rights Society. Premises where milk is sold by the glass should be registered with the local council and must comply with their requirements. Sale and Supply outside Permitted Hours The hours during which liquor may lawfully be sold are fixed by the Licensing Act, 1953, but may, within certain limits, be varied by the local justices, or, in the case of a club, by the club rules. A member of a licensed club may buy liquor in the club for consumption off the premises, provided that he buys it himself, on the premises, during permitted hours, and pays for it at the time of sale. In other licensed premises which have(as in the case of a bar) an on-licence, liquor may, subject to any special conditions of the licence, be sold for consumption on or off the premises, but, with the following exceptions, the sale, supply or consumption must take place during permitted hours. The exceptions are as follows: I. A person resident in a licensed hotel or club may at any hour buy and consume liquor and treat other residents, but out side permitted hours he may not buy liquor for a non-resident, nor may the non-resident consume any liquor on the premises outside of hours.
